Menstrual rights | Supreme Court Declares Menstrual Health a Fundamental Right; Free Sanitary Napkins Mandated in Schools

(Menstrual rights) Declaring menstrual health to be an inseparable part of the fundamental right to life guaranteed under the Constitution, the Supreme Court on Friday, January 30, delivered a historic verdict. As per the ruling, all states and Union Territories must provide free oxo-biodegradable sanitary napkins to girls in government, aided, and unaided schools in both urban and rural areas. The Court has also made it mandatory to construct separate and adequate toilets for all male and female students.

(Menstrual rights) The order was passed by a bench comprising Justice J.B. Pardiwala and Justice R. Mahadevan, which strongly emphasized gender justice and educational equality. The Court made it clear that no girl’s education should be disrupted due to menstruation, stating that ensuring this is a constitutional duty of the State.

(Menstrual rights) The Supreme Court also issued a stern warning of strict consequences for non-compliance. Private schools violating the directives will face cancellation of recognition, while state governments will be held directly accountable for failures in public educational institutions.
This landmark judgment is expected to strengthen the rights to health, dignity, and education for millions of school-going girls across the country.
